QUESTION!
If a skier comes down and slams into the snowboarder and the skier sues....who does the skier sue? The resort or the snowboarder?
QUESTION!
Is the resort liable for normal collisions with people? If not, then the resort is only liable for people using the lifts.
I really do not know the answers to these questions. Please tell me.
The resort is not responsible for reckless skiers or natural hazards (trees, tree wells, holes in the snow, rocks, boulders).
The resort is responsible for preventing accidents involving manmade hazards: tower poles, snowmakers, grooming equipment, chair lifts, avi ordinance, as well as obvious geographic hazards - rivers, cliffs, waterfalls...
The resort is also responsible for traffic control - blind merging or crossing trails.
If you are injured by a reckless skier you may sue that person for your injuries and I believe they also can be charged with assault.
If you can prove your are injured by a skier because of unmarked blind trail crossings, you may sue the resort.
If the skier ignores warning signs at the trail crossings, he/she is reckless and culpable.

Easy....if the resort allows non paying people to skin up the hill and a paying customer slams into them and is injured then the resort can be held liable for allowing this condition to exist.
Then you are saying that if I walked up the hill carrying my skis and someone slams into me and we were all paying customers, then the resort is liable? And I was NOT being reckless. I was just getting my child's ski about 40 feet away...(and yes this has happened often).
This does not seem right.

You can sue anyone you want at any time but that doesn't mean you will win. Your being a bit silly with your comparisons and crazy examples.
