I don't want to get into the ethical aspects of this debate. FWIW, Voile and G3 already manufacture their free pivot 75mm telemark bindings courtesy of Black Diamond. From reading the patents, BD is most likely asking 22 Designs to pay a licensing fee on more shared design elemnts than the free pivot and mode switch.
